By accessing this Site (including when submitting any information to us through the Site), you acknowledge and agree to accept the following: (i) these Terms of Use (“Terms”), which constitute a legal agreement between you and World Insurance; (ii) our privacy policy (the “Privacy Policy”); and (iii) any other legal notices, conditions or guidelines located within the Site. These Terms apply to the Site and any site or application (as well as any features, widgets, plug-ins, content, downloads, or other services) that are offered by World Insurance and that post a link to these Terms (collectively, the “Services”), regardless of how you access or use them, whether via personal computers, mobile devices, or otherwise (each a “Device”). They supplement but do not replace or take precedence over other agreements regarding our Services, insurance policies or other instruments that we may offer or you may purchase. Dispute Resolution Notice
These Terms include important Dispute Resolution provisions, including arbitration of disputes and waiver of jury trials. These provisions affect your rights to bring certain types of actions, and govern how those actions are resolved. By using this website, you agree that any disputes arising out of or related to these Terms will be resolved as outlined in the Dispute Resolution section of the Terms. Please review the Terms carefully before proceeding.
1. Important Legal Information about Privacy
World Insurance’s Privacy Policy applies to your use of the Services and forms an integral part of your agreement with us, and is incorporated by reference into these Terms. You should read the Privacy Policy carefully before you use our Services since, by using the Services, you will be agreeing to everything in these Terms, including the terms contained in our Privacy Policy.
2. Modification to These Terms and Our Site
We may add to, update, delete from, or modify the Site at any time in our sole discretion. We reserve the right (at any time and for any reason) to change or revise the Terms. We may post or display notices of changes to the Terms on the Site or may notify you of such changes. Once posted, these changes to the Terms become effective immediately. If any change that we make is not acceptable to you, promptly stop using the Site. Any use by you of the Site after any changes to our Terms become effective will signify your agreement to those changes. You should check back regularly and review these Terms so that you are aware of the most current rights and obligations that apply to your agreement with us. Nothing in these Terms confers any third-party rights or benefits to you. It is your responsibility to visit the Site frequently to review carefully the current terms and conditions of use that govern your continued use of the Services and access to Site Content (as defined below). You agree that World Insurance will not be liable to you or to any third party for any modification, suspension or discontinuance of the Site.
The above does not apply to the arbitration and class action provisions set forth in Section 20 however, which can only be modified upon mutual agreement between you and us.
3. Ownership of Services Content
Unless otherwise noted, all photographs, pictures, graphics, and all other images, including digital, printed, and video images, and portions thereof, and all content, data, information, news, and all other text and materials, including digital, printed and audio materials, along with the layout and design of the Services, including the Site, and all documentation, data, services, features, products, and other content in the Services (collectively, “Services Content”) are protected by the copyright laws of the United States and other jurisdictions. All Services Content is owned by, or licensed to, World. Services Content may not be reproduced, modified, redistributed, or otherwise used in any way without a written license with the applicable Services Content owner. You agree not to copy, modify, or create a derivative work of, sell, resell, sublicense, transfer, or distribute any or all of Services Content, in whole or in part.
4. World Insurance Trademarks
World Insurance trademarks, including the trademarks “World Insurance,” the logo, all page headers, graphics, images, symbols, trade names, and other World Insurance marks found at the Site are the proprietary property of World (collectively the “Marks”). All other trademarks, registered trademarks, product names and company names or logos mentioned on the Site are the property of their respective owners. Nothing contained on the Site should be construed as granting any license, interest, or right of any kind to use any trade names, trademarks, service marks, or logos appearing on the Site without the express prior written consent of the owner. Use of the Marks is strictly prohibited without the prior written consent of World.
5. Third-Party Trademarks
Third-party trademarks may appear on the Site from time to time. You may not use these trademarks without the prior written permission of their respective owners. You acknowledge and agree that nothing on the Site or Services grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any of these third-party trademarks, nor may anything be construed to mean that World Insurance has authority to grant any right or license on behalf of any third-party trademark owner. Reference to any products or services does not constitute or imply endorsement, sponsorship or recommendation by us.
6. Use of Services Content
Subject to and conditioned on your continued compliance with these Terms and all other terms and conditions that World Insurance may provide to you from time to time, World Insurance grants you a personal, limited, non-exclusive, non-assignable, non-transferable, non-sublicensable, revocable license to access and display on your Device for your own use (but not copy or transfer or broadcast or otherwise use in any way) the Services Content found at this Services for your personal, non-commercial, and educational use only. You further agree not to change or delete any proprietary notices from materials downloaded from the Services. Except for the foregoing limited license, no right, title, or interest shall be transferred to you. You may use the Site only for lawful purposes and in accordance with these Terms.
7. Reservation of Rights
All rights not expressly granted by World Insurance herein are reserved. Nothing on the Services or in these Terms grants, expressly or implicitly, by estoppel or otherwise, any right or license to use any Services Content or other materials of any third party or may be construed to mean that World Insurance has the authority to grant any license on behalf of any third party.
8. Restrictions, Limitations and Conditions of Use
Any unauthorized use of our Services or Services Content for any purpose is prohibited. Your rights to the Services are given on the condition that you use the Services in accordance with these Terms. You may not use the Services for any unlawful purpose and you may not, nor may you help or induce others to:
- access, solicit, collect or use any personally-identifying information about any other users of the Services or anyone else;
- restrict or inhibit others from using the Services;
- avoid, impair, or attempt to circumvent security or technological measures used to protect the Services or Services Content;
- transmit to or introduce at the Services any viruses, harmful software, or other modifications or changes to the Services or reverse engineer, decipher, decompile, disassemble, reverse assemble or modify any Services source or object code or any software or other services or processes accessible through any portion of the Services or Services Content (to the extent such restriction is permitted under applicable law);
- submit, upload, email or otherwise transmit any content or other materials, to or through the Services that: a) is threatening, abusive, defamatory, obscene, vulgar, offensive, or otherwise objectionable, or which may harm minors; (b) infringes or violates the rights of others; or (c) has an advertising, political marketing, promotional or other commercial purpose, unless otherwise expressly permitted by the Services;
- engage in any activities that interfere with another user’s access to the Services or the proper operation of the Services;
- distribute or copy any Services Content manually or by using any robot, scraper, crawler, or any other automatic device or process; frame or utilize framing techniques to enclose any Services Content; or use content from our Services in a manner that suggests an unauthorized association with any of our or third party’s products, services or brands;
- violate copyright, trademark, or other intellectual property laws;
- use, reproduce or remove any copyright, trademark, service mark, trade name, or other proprietary notation displayed on the Site without permission;
- impersonate or falsely state or otherwise misrepresent yourself or your affiliation with a person or entity;
- obtain or attempt to access any materials through any means not intentionally made available through the Site; or
- use any Services Content to train large learning models or in connection with any artificial intelligence input or output services.
World Insurance has no obligation to monitor your interaction with the Services but reserves the right to review or monitor the Services and any user submissions, if permitted, in its sole discretion.
9. Creating and Terminating Accounts
Some Services features may require an applicable user to register for an account through an online registration process. When you register for an account, you will select login credentials and you agree that you: (i) will not use a username (or e-mail address) used by someone else, that impersonates another person, belongs to another person, violates the intellectual property or personal rights of any person or entity, or that is offensive; (ii) will provide true, accurate, current and complete registration information during any registration process and will update it as needed to keep it accurate; (iii) will immediately notify us of any unauthorized use of your account, password or username, or any other breach of security; and (iv) will not sell, transfer, or assign your account or any account rights. You are solely responsible for all activities that occur under your account, regardless of whether you authorize the activity. You are solely responsible for maintaining the confidentiality of your account credentials and for restricting access to your Device(s) so that others may not access any protected portion of our Services using your name, username, or password. We will not be liable for any loss or damage (of any kind and under any legal theory) to you or any third party arising from your inability or failure for any reason to comply with any of the foregoing obligations in this section. If any information that you provide, or if we have reasonable grounds to suspect that any information that you provide, is false, inaccurate, or incomplete, or violates these Terms, or any applicable law, we may suspend or terminate your account. We also reserve the more general and broad right to terminate your account, or suspend or otherwise deny you access to it, or its benefits, all in our sole discretion, for any reason, and without advance notice or liability.
10. Online Reporting of Claims.
The Services may permit you to report claims for insurance benefits under an existing insurance policy. If the Services permit you to report an online insurance claim, you agree that you will use accurate, complete and valid information to complete your report.
If reporting an insurance claim online is available, you may be redirected to a third party’s website. World Insurance does not control any third-party website, and these Terms do not apply to your use of any third-party website. Please be sure to read the terms of use (and privacy policy) of any third-party website you visit.
11. Modifications to Services, Products.
By providing information or other materials, such as insurance policy descriptions, on or through our Services, World does not in any way guarantee that the information or other materials will remain available to you, are available in your jurisdiction, or that you will qualify for any of the products or services we offer. World makes no representations as to the completeness, reliability, accuracy, or timeliness of Services. We reserve the right to correct any errors, inaccuracies, or omissions, change or update information on the Services, and cancel any orders if any information in the order is inaccurate at any time without prior notice (including after you have submitted your order). We undertake no obligation to update, amend, or clarify information on the Services including without limitation pricing information except as required by law. World reserves the right, at any time, to change its products, services, and pricing, effective immediately upon posting on our Services or by e-mail delivery to you. In accordance with various applicable insurance laws and other regulatory restrictions, insurance products and services referenced on the Services may not be available or suitable for all jurisdictions.
Except as expressly stated herein, the information contained on the Site and Services is not an offer to sell, bind or issue, or a solicitation to purchase, any insurance product or other product or service by World Insurance. Rather, the product and services information are provided to you so you can learn what products we offer. We may make improvements and/or changes to the products, services and/or programs described on these Services at any time without notice to you. The listing on the Services does not necessarily imply our endorsement of such Service. These Terms do not cover any purchases made from, or other interactions with other sites or services.
The Site and Services do not amend, modify or supplement any insurance policy. Consult the actual insurance policy or your insurance broker or contact us for the name of a representative who can supply you with details regarding terms, conditions, coverages, exclusions, products, services and programs which may be available to you. Your eligibility for particular insurance products and services is subject to final determination of underwriting qualifications and acceptance by World Insurance’s underwriting insurance company providing such products or services.

The Services may contain hyperlinks to websites operated by persons or entities other than World Insurance or any of its affiliates. Such hyperlinks are provided for your reference and convenience only. Please be aware that World Insurance does not monitor, endorse or accept responsibility for the content on such websites or the operator or operations of such websites. You are solely responsible for determining the extent to which you may use any content or services provided at any other websites that you might link to from these Services. You agree not to hold World responsible or liable for the content or operation at any other website to which you might link from these Services.
13. IMPORTANT: DISCLAIMER AND LIMITATION OF LIABILITY
Your use of the Services is at your sole risk. The materials, Services Content and services offered on the Services are provided “AS IS” and without warranties or conditions of any kind. To the fullest extent permissible pursuant to applicable law, we disclaim all warranties of any kind, whether, express, implied, statutory or otherwise, including, but not limited to, implied warranties of non-infringement, merchantability and fitness for a particular purpose, title, and non-infringement.
We do not warrant that the use of the Services will meet your requirements, be uninterrupted or error-free, that defects will be corrected, or that the Services or the server(s) that make it available or any advertised or hyperlinked site are free of viruses or other harmful components or that the Services, server(s), or advertised or linked websites will be accessible at all times. We do not warrant or make any representations, conditions or other terms regarding the use of the Services or any information contained therein, including Services Content, with respect to correctness, accuracy, reliability, graphics, links or otherwise. You assume the entire cost of all necessary servicing, repair or correction to any equipment you use to access the Services.
Documents, information, graphics and other materials appearing on the Services may include technical inaccuracies, miscalculations, typographical errors, and out-of-date information. Use of such documents, information, graphics or other materials is at your own risk.
You waive any and all claims and rights against World Insurance and our affiliates, parents, and successors and each of our employees, assignees, officers, agents and directors (the “World Insurance Parties”) resulting from injury or damage to, or destruction, theft, or loss of, any property, or person, to the maximum extent permitted by the applicable laws of your jurisdiction of residence. None of the World Insurance Parties will be liable to you under any cause of action, for any direct, indirect, special, incidental, consequential, statutory, reliance or punitive damages, including loss of profits or business interruption. None of the World Insurance Parties will be liable to you for your attorneys’ fees or costs under any statutory claim.
In the event that a court finds the above disclaimer of direct damages to be unenforceable, in no event will World Insurance’s total aggregate liability for all damages, including without limitation all claims, losses, liabilities, costs and expenses (including legal fees and expenses) to you related to the Services or Services Content, or these Terms, exceed the lesser of (a) the direct damages suffered by you, or (b) $100.
The provisions in these Terms are intended to be only as broad and inclusive as is permitted by the laws of your state or country of residence. Certain jurisdictions have heightened consumer protection laws that may make certain portions of these Terms inapplicable to you. No provision of these Terms shall limit or waive your rights as a consumer under the law of your state or country of residence. In any event, World Insurance reserves all rights, defenses and permissible limitations under the law of your state or country of residence.
14. Indemnification
You hereby agree to indemnify, defend and hold harmless the World Insurance Parties from and against any and all claims, liabilities, and expenses (including reasonable attorneys’ fees), resulting from your use of the Services or any breach of these Terms by you.
15. Ability to Accept Terms
You affirm that you are the age of majority in your jurisdiction and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in these Terms, and to abide by and comply with these Terms. The Services are not intended for children under the age of eighteen (18). If you are under 18 years of age, then please exit now and do not use these Services.
16. Geographic Limitations
World Insurance controls and operates the Services in the United States. If you use our Services from other locations, you are doing so at your own initiative and are responsible for compliance with applicable local laws regarding your online conduct and acceptable content, if and to the extent local laws apply. The Services may describe products and services that are available only in certain jurisdictions. We reserve the right to limit the availability of our Services. Further information on your rights regarding personal information collected on the Services are set forth in our Privacy Policy.
17. No Waiver
Except as expressly set forth in these Terms, no failure or delay by you or World Insurance in exercising any of rights, powers or remedies under these Terms will operate as a waiver of that or any other right, power or remedy. Any waiver of any provision of these Terms must be in writing and signed by an authorized representative of World Insurance to be valid. A waiver of any provision hereunder shall not operate as a waiver of any other provision, or a continuing waiver of the same provision in the future.
18. Interpretation, Validity and Assignment of these Terms
If any provision of these Terms is for any reason deemed invalid, unlawful, void or unenforceable by a court or arbitrator of competent jurisdiction, then that provision will be deemed severable from these Terms, and the invalidity of the provision will not affect the validity or enforceability of the remainder of these Terms (which will remain in full force and effect). To the extent permitted by applicable law, you agree to waive, and you hereby irrevocably waive, any applicable statutory and common law that may permit a contract to be construed against its drafter. Wherever the word “including” is used in these Terms, the word will be deemed to mean “including, without limitation.”
We may assign, novate or subcontract any or all of our rights and obligations under these Terms at any time.
19. Applicable Law.
These Terms will be governed by, construed and enforced solely in accordance with the laws of the State of New Jersey without giving effect to its principles of conflicts of law or the application of any law of any other jurisdiction. Subject to the dispute resolution and arbitration provisions set forth below, you hereby irrevocably consent and submit to the personal jurisdiction and venue of the state and federal courts located in New Jersey.
If you are a consumer, however, this provision shall not be construed to limit your rights under any applicable consumer protection laws of your state or jurisdiction of residence to the extent such consumer protection laws may not be waived.
20. Dispute Resolution; Information Resolution and Formal Resolution by Arbitration / Class Action Waiver
In order to expedite and control the cost of disputes, you and World Insurance agree that any legal or equitable claim relating to the use of the Services or the purchase of any World Insurance product or service from these Services (referred to as a “Claim” within this section) will be resolved as follows:
1. Informal Resolution:
You and World Insurance will first attempt to resolve any Claim informally. In the event that any dispute between World Insurance and you arises out of or relates to: (i) these Terms; (ii) the Services; or (iii) the purchase of any products or services from the Services, you and we agree to try to promptly resolve any such dispute informally. Please send a written notice describing the dispute to World Insurance at legaldepartment@worldinsurance.com
2. Formal Resolution by Arbitration / Class Action Waiver.
READ THE FOLLOWING ARBITRATION PROVISION CAREFULLY, IT LIMITS YOUR RIGHTS AND REMEDIES, INCLUDING THE RIGHT TO MAINTAIN A COURT ACTION. You agree that any dispute, controversy or Claim arising out of or relating to these Terms, your use of the Services, or the purchase of any products or services from these Services, or the determination of the scope or applicability of arbitration shall be governed as set forth below.
If you and World Insurance cannot resolve a Claim informally, any Claim asserted by either party will be resolved only by binding arbitration (“Arbitration”). By agreeing to Arbitration, both you and World Insurance understand and agree that all processes, such as a court action or administrative proceeding, to settle disputes shall be decided by a single arbitrator and that you are irrevocably waiving your rights to maintain other available resolution processes, such as a court action or administrative proceeding, to settle disputes. Instead of suing in court, both you and World Insurance each agree to settle disputes (except certain small claims and intellectual property claims as set forth below) only by Arbitration.
ARBITRATION MEANS THAT YOU WAIVE YOUR RIGHT TO A JURY TRIAL.
The rules in Arbitration are different. There is no judge or jury, and review is limited, but an arbitrator can award the same damages and relief and must honor the same limitations stated in these Terms as a court would. You and World Insurance agree that the Arbitration will be conducted under the American Arbitration Association Consumer Arbitration Rules (referred to as the “AAA Rules”) and under the rules set forth in these Terms. If there is a conflict between AAA Rules and the dispute resolution rules set forth in these Terms, the dispute resolution rules set forth in these Terms will govern. In Arbitration you may seek any and all remedies otherwise available to you pursuant to the law of the governing jurisdiction. If you decide to initiate Arbitration, World Insurance agrees to pay the Arbitration initiation fee and any additional required deposit required by AAA to initiate your Arbitration. You and World Insurance agree to pay the costs of the Arbitration proceedings, provided however, that if you are a consumer you shall not be required to pay more than $250.00 of the fees or such amount as the AAA Rules may later prescribe. All other fees, such as attorneys’ fees and expenses of travel to the Arbitration, will be paid in accordance with AAA Rules. The arbitration will be held at a location in your jurisdiction, unless you and World Insurance both agree to another location or telephonic or videographic Arbitration. To initiate Arbitration, you or World Insurance must do the following:
- Write a demand for Arbitration. The demand must include a description of the Claim with reasonable particularity and the amount of damages sought to be recovered. You can file a Demand for Arbitration at https://www.adr.org/;
- Send one copy of the Demand for Arbitration to the other party.
Special rules in the Arbitration Proceeding.
- Except for errors of law, the arbitrator’s decision shall be final and binding on all parties and may be enforced in any court that has jurisdiction.
- Neither you nor World Insurance are entitled to join or consolidate Claims in Arbitration by or against other individuals or entities or arbitrate any Claim as a representative member of a class or in a private attorney general capacity.
THIS MEANS THAT YOU IRREVOCABLY WAIVE YOUR RIGHT TO INITIATE OR PARTICIPATE IN ANY CLASS OR CONSOLIDATED ACTION WHATSOEVER.
However, you may opt out of this Section, and out of arbitration (and class action waiver) if you notify us that you are exercising this “opt out” option within thirty (30) days of accepting these Terms. If you opt out, you will not be bound by this Section, or by these arbitration provisions.
Accordingly, unless you opt-out, you and World Insurance agree that the AAA Class Action Rules do not apply to our Arbitration. A court may sever any portion of this dispute resolution provision if it finds such unenforceable, except for the prohibition on class, representative and private attorney general arbitrations.
Notwithstanding the obligation to arbitrate all Claims under these Terms, you may assert an individual Claim in small claims court in lieu of Arbitration. Likewise, notwithstanding such obligation, either you or we may seek injunctive and/or equitable relief in any jurisdiction or court where it is permissible to do so, in order to remedy or seek relief regarding alleged violations of intellectual property rights (inclusive of trade secret rights).
To the extent permitted by applicable law, if any dispute or Claim results in a lawsuit, you and we knowingly and voluntarily agree that a judge, without a jury, will decide the case. You understand and knowingly and voluntarily agree that you and we are irrevocably waiving the right to a trial by jury.
21. Exclusions and Limitations; Consumer Protection Notice.
If you are a consumer, the provisions in these Terms are intended to be only as broad and inclusive as is permitted by the laws of your state of residence or jurisdiction. Certain states, like New Jersey, have heightened consumer protection laws that may make certain provisions of these Terms inapplicable to you. Specifically, if you are a New Jersey consumer, certain provisions of these Terms do not limit or waive your rights as a consumer under New Jersey law and the provisions in these Terms, as they pertain to you, are intended to be only as broad and inclusive as is permitted by the laws of the State of New Jersey. No provision of these Terms shall limit or waive your rights as a consumer under the law of your state of residence. In any event, World Insurance reserves all rights, defenses, and permissible limitations under the law of your state of residence or jurisdiction.
22. Termination/Exclusion
We reserve the right, in our sole discretion, to revoke, terminate or suspend any and all privileges associated with accessing the Services for any reason or for no reason whatsoever, including improper use of the Services or failure to comply with these Terms, and to take any other action we deem appropriate.
Provisions relating to Services Content, Trademarks, Disclaimers, Limitations of Liability, Indemnification, Waiver, Applicable Law, and Dispute Resolution, as well as Section 20 (regarding arbitration and class action waiver) shall survive any termination.
23. User Submissions
You acknowledge and agree that any questions, comments, suggestions, ideas, feedback or other information that you provide to World Insurance (“User Submissions”) are not confidential and you grant World Insurance a worldwide, royalty-free, perpetual, irrevocable, sublicensable, transferable license to distribute, publish, modify, edit, create derivative works or otherwise use your User Submissions. World Insurance shall be entitled to the unrestricted use and dissemination of these User Submissions for any purpose, commercial or otherwise without any acknowledgement of or compensation to you.
